Hukum Wakalah Dan Beberapa Perkara Berbangkit Dalam Ibadat Korban

Keputusan: 

Muzakarah Jawatankuasa Fatwa Majlis Kebangsaan Bagi Hal Ehwal Ugama Islam Malaysia Kali Ke-66 yang bersidang pada 25 Nov 2004 telah membincangkanHukum Wakalah Dan Beberapa Perkara Berbangkit Dalam Ibadat Korban. Muzakarah telah memutuskan bahawa:

  1. Hukum asal wakalah adalah harus.
     
  2. Harus bagi wakil mewakilkan kepada orang lain dengan keizinan muwakkil.
     
  3. Harus bagi wakil mewakilkan kepada orang lain sekiranya tidak mampu atau tidak layak melakukan sendiri perkara yang diwakilkan tersebut.
     
  4. Harus mengagihkan daging korban ke tempat atau negara lain.
     
  5. Tidak harus mengagih dan memberi makan daging korban kepada orang bukan Islam.

 

Keputusan (English): 
 
The Ruling on Appointing a Representative to Perform Certain Tasks on One’s Behalf (Wakalah) and Issues on the Sacrifice of Livestock (Qurban)

Decision:

The 66th Muzakarah (Conference) of the Fatwa Committee of the National Council for Islamic Religious Affairs Malaysia held on 25th November 2004 has discussed the Ruling on Appointing a Representative to Perform Certain Tasks on One’s Behalf (Wakalah) and Issues on the Sacrifice of Livestock (Qurban). The Conference decided that:
 
1. The original ruling on wakalah is permissible.

2. It is permissible for the representative (wakil) to appoint another representative with the permission of the owner (muwakkil).

3. It is permissible for the representative (wakil) to delegate to another representative if he is not capable of or not qualified to perform the task appointed to him.

4. It is permissible to distribute the meat of the sacrificed livestock to other places or countries.

5. It is not permissible to distribute or feed the meat of the sacrificed livestock to Non-Muslims.
