Muzakarah Jawatankuasa Fatwa Majlis Kebangsaan Bagi Hal Ehwal Ugama Islam Malaysia Kali Ke-37 yang bersidang pada 23 Mar 1995 telah membincangkan Tuntutan fasakh Nikah Isteri Kerana Suami Mengidap Penyakit Aids Atau Penagih Dadah. Muzakarah telah meluluskan fatwa tuntutan fasakh nikah isteri kerana suami mengidap penyakit aids atau penagih dadah dengan perakuan dari pakar perubatan yang adil.

Application For Dissolution of Marriage (Fasakh Nikah) by Wife Whose Husband is Afflicted with AIDS or a Drug Addict

Decision:

The 37th Conference (muzakarah) of the Fatwa Committee National Council of Islamic Religious Affairs Malaysia held on 23rd March 1995 has discussed application for dissolution of marriage by a wife because the husband is afflicted with AIDS or a drug addict. The committee has granted permission for such application, supported with report by a trusted medical doctor.
